Agreement to Terms

By accessing or using the 406 Industries website (406industries.com) or engaging our CNC machining, prototyping, or consulting services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

Services Description

406 Industries provides CNC machining, mill-turn operations, multi-axis milling, rapid prototyping, design for manufacturability (DFM) consultation, and production support services. All services are performed at our facility in Bigfork, Montana. Specific project terms, pricing, timelines, and deliverables are defined in individual quotes and purchase orders agreed upon between 406 Industries and the client.

Quotes and Orders

• All quotes provided by 406 Industries are valid for 30 days unless otherwise stated.
• Quotes are based on the specifications, drawings, and files provided at the time of quoting. Changes to specifications may result in revised pricing.
• An order is considered confirmed upon written acceptance (email or signed purchase order) and receipt of any required deposit.
• Lead times are estimates and may vary based on shop capacity, material availability, and project complexity.

Intellectual Property

All designs, CAD files, drawings, and specifications provided by the client remain the exclusive intellectual property of the client. 406 Industries claims no ownership over client-provided designs. We will not reproduce, distribute, or share your designs with any third party without your explicit written consent. Non-Disclosure Agreements (NDAs) are available and encouraged for sensitive projects.

Payment Terms

• Payment terms are Net 30 unless otherwise agreed in writing.
• Prototype and first-time orders may require a deposit of up to 50% prior to production.
• Late payments may be subject to a 1.5% monthly service charge.
• 406 Industries reserves the right to hold completed parts until payment is received in full.

Quality and Inspection

All parts are manufactured to the tolerances and specifications provided in the client's drawings or CAD files. Material certifications are provided for all materials upon request. Clients are responsible for inspecting parts upon receipt and reporting any non-conformances within 10 business days of delivery. Parts manufactured to client specifications that meet the documented tolerances are considered conforming.

Limitation of Liability

406 Industries' liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific order in question. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, production delays, or costs incurred from the use or inability to use parts manufactured by 406 Industries. Parts are manufactured to client-provided specifications; 406 Industries is not responsible for design deficiencies in client-provided drawings.

Cancellation and Changes

• Orders may be cancelled or modified prior to the start of production without penalty.
• Once production has begun, cancellation may incur charges for materials purchased and work completed.
• Design changes after production has started may result in additional charges and extended lead times.
